Terms and Conditions

Touring Monkeys (the “Organiser”) legally operates under Spofibo GmbH, an outdoor event company registered in Switzerland. 

Touring Monkeys (the “Organiser”) provides organised activities (the “Events”) to interested individuals (the “Participant”). 

By booking or participating in an event, the Participant confirms that he/she has read, understood and agrees to the Terms and Conditions stated herein. 

Accidents, injury, and deaths

The Participant is fully aware that the Events organised by the Organiser involve the possibility of accidents, injuries or death. 

The Participant is fully aware that the Events could be held on public or private roads, paths, by-ways and/or other means of access and transportation, with potential accidents that can be caused by road users, natural calamities, and other third parties. The Organiser cannot be held responsible for the occurrence of any of these incidents whether directly or indirectly resulting before, during or after any Event.

The Participant agrees that the Organiser and respective team members shall not be held liable for any damage to, or loss of, property/equipment or injury to, or death of the Participant. 

The Participant waives any claim against the Organiser for any such loss, damage, expense, injury, or death that the Participant may incur or suffer as a result of his/her participation in any part/parts of an Event due to any cause whatsoever including any form of negligence.

Medical, physical, and emotional condition

The Participant is solely responsible for his/her personal safety, physical, emotional preparation, and fitness to participate in any Event. 

The Participant is responsible for his/her own judgment, choices, and actions when signing up and during the Event.

The Participant is responsible to ensure his/her physical and mental fitness to take part in any Event. If the Participant is suffering from any medical condition or illness, it is at his/her discretion the decision to take part in any Event. The Organiser accepts no liability for exacerbating his/her condition or any ill effects that he/she may suffer during or after the Event.

The Participant undertakes and agrees to remove himself/herself at any point during the event if he/she senses or observes any unusual hazard or unsafe condition, or he/she is unable or unfit to safely continue for any reason.

The Organiser reserves the right to stop the Participant from participating at any point during the Event should the Organizer deem that the Participant’s physical condition is not sufficient or if his/her equipment is unsafe.

Insurance

The Participant is responsible for his/her insurance against any risks associated with the Events.

Payment

Terms of Payment

The full amount has to be paid upon booking.

Cancellation policy 

If the Participant cancels his/her booking:

  • 30 days prior to the Event start date, a cancellation fee equivalent to 50% of the Event cost applies.
  • less than 30 days prior to the Event start date, a cancellation fee equivalent to 100% of the Event cost applies.

The Participant can sell his/her booking to another interested party who meets the fitness requirements of the particular Event. In this case, the Organiser is entitled to an Administration Fee of CHF 30.

The Organiser reserves the right to cancel any Event for any reason whatsoever. In the event of cancellation by the Organiser, the Participant will be offered an alternative Event or a full refund. However, this will not apply for cancellations due to force majeure (adverse weather conditions, war, strikes, earthquake, flooding, epidemic, etc). The Participant is responsible to have adequate insurance to cover these circumstances.

Event changes, and cancellation by the organiser

The Participant is aware that the conduct of outdoor events depends on uncontrollable external factors particularly weather conditions. In this regard, the Organiser has the full right to change the itinerary prior to or during the Event or to cancel as deemed necessary for reasons of unforeseen circumstances, operational concerns, or concerns for the health, safety, enjoyment, or comfort of the Participants of the Event. Any changes are at the discretion of the Organiser.

Vouchers

Touring Monkeys’ vouchers are valid for 1 year from the voucher creation date.

Covid measures

No COVID certificate is required for Touring Monkeys outdoor activities. However, some of our events imply meals, overnight stays or travels that might require a certificate. It is the participant’s responsibility to check the current measures in place and do the necessary before the event start.

Use of images/videos for marketing purposes

​The Participant is aware that photos or videos of him during the event may be taken by the Organiser or other Participants. The Participant grants full consent to the Organiser the use of these images and videos that may feature or contain the Participant for marketing, promotions, or creation of promotional materials. If the Participant does not agree to the use of images and videos of himself in any marketing and publicity material, the Participant should inform the Organiser prior to the start of the Event. If there is no prior notification in this regard, the Organiser has the full right to use such media as outlined above.

Personal information

The Participant’s submission of personal information through the website is governed by the Organiser’s Privacy Policy. Click here to view the Privacy Policy.

Governing law

These Terms and Conditions and any separate agreements provided by the Organiser to the Participant shall be governed by and construed in accordance with the laws of Switzerland.

Changes to Terms and Conditions

The Participant of any Event can review the most current version of the Terms and Conditions at any time on this page.

The Organiser reserves the right, at their sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to the website. It is the Participant’s responsibility to check the Organiser’s website periodically for changes. The Participant’s continued use of or access to the website or the Event following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
